Hurley zoning board overturns code ruling, allows Twin Lakes project to seek permits
Arizona Investissements successfully challenged a town code enforcement ruling and will be allowed to resubmit a request for permits for its Twin Lakes glamping complex plan.
On Thursday, The Zoning Board of Appeals voted 6-1 to allow the developer more time to start the project after recognizing that delays were due to a lack of clearances from the state Department of Environmental Conservation before town construction permits could be finalized.
Among the unresolved issues that delayed developers was the absence of a state pollutant discharge elimination system permit, which is needed to construct a wastewater treatment system at the planned 58-unit luxury cabin project.
“In the course of our review…well after the (code enforcement officer) made his determination…we received information the DEC did not respond to an application for the SPDES permit until the one-year (town limit) for the special use permit,” zoning board Chairman Josh Vogt said.
