Hurley zoning board overturns code ruling, allows Twin Lakes project to seek permits

Arizona Investissements successfully challenged a town code enforcement ruling and will be allowed to resubmit a request for permits for its Twin Lakes glamping complex plan.

On Thursday, The Zoning Board of Appeals voted 6-1 to allow the developer more time to start the project after recognizing that delays were due to a lack of clearances from the state Department of Environmental Conservation before town construction permits could be finalized…..

Among the challenges in keeping the project’s timeline manageable was a change in the code enforcement office due to a medical leave by Glenn Hoffstatter. This led to the town not following up on whether the status of project requirements needed to come from the town or the developer.

“No inspection had been done by the building inspector within that one year,” Vogt said. “When we went and studied…the language in the (town Planning Board) resolution it became very clear that it was ambiguous and there was no real determination of where that responsibility lied.”
